Joise Ampara, 24, of Dorchester, was arrested last friday on Massachusetts Sex Crimes Charges for allegedly exposing himself on an MBTA train station. He was charged with Open & Gross Lewdness.

According to Massachusetts Bay Transportation Authority Police, Amparo was allegedly waiting on the train platform when he pulled down his pants and exposed his rear to over 40 passengers. Amparo then allegedly turned to the crowd and fondled his genitals before leaving the station.

After his arraignment on the Sex Crimes Charge of Open & Gross Lewdness, Amparo was ordered to report to the Lemuel Shattuck Hospital for evaluation.

Michael Cimmino, 54, of Braintree, was initially charged with Massachusetts Sex Crimes in Quincy District Court for alleged inappropriate sexual conduct towards a child under 14. At his arraignment in Quincy on January 3, Cimmino entered a plea of not guilty to sex crimes charges including Kidnapping; Assault with Intent to Rape; and eight counts of Indecent Assault & Battery on a Child Under 14.

This past week, however, Cimmino was charged with additional Sex Crimes after a second alleged victim came forward claiming inappropriate sexual conduct. He was again arraigned in Quincy District Court on sex crimes charges including Indecent Assault & Battery on a Person Under 14 and Open & Gross Lewdness.

According to the Norfolk County District Attorney’s Office, Cimmino is alleged to have touched the child inappropriately when the child was at Cimmino’s house for a New Year’s sleepover. The ‘inappropriate touching’ as alleged by the prosecutor, consists of Cimmino allegedly rubbing the head and shoulders of the child…

At his arraignment yesterday in Suffolk Superior Court, Marcus Colono, 33, of Cambridge, was formally charged in connection with Rapes of two Boston college students in 2008. He was charged with four counts of Aggravated Rape, two counts of Assault & Battery with a Dangerous Weapon, Home Invasion, and Armed Robbery.

At his arraignment, the Suffolk County District Attorney’s Office alleges that, in 2008, Colono broke through the apartment door of two female college students in Brighton, tied them up and raped both women while threatening them with a knife.

Although Boston Police had obtained DNA evidence from those rapes, the case had gone unsolved until a Suffolk County Grand Jury ordered him to submit a DNA sample, which ultimately matched the DNA taken from one of the females. That DNA sample was also matched to the brutal Cambridge Home Invasion for which Colono had already been charged.

dmclean.jpgDonnie McLean, 46, was arrested last Friday for Sex Crimes after he allegedly began fondling himself on a Route 28 bus headed towards Ruggles Station at Northeastern University in Boston.

McLean, who is also a Level 3 Sex Offender, was arrested and charged with Open & Gross Lewdness.

According to the MBTA Police, McLean allegedly initially evaded paying his fare for the bus by going in through the rear doors at Dudley Station. He then sat in the back near a young female and, according to the victim, began touching himself very inappropriately.

massart.jpgA Boston man, Venard Shepard, 21, of Roxbury, Massachusetts, was arrested this pasty Thursday in New Bedford on an outstanding warrant for an alleged sexual assault on a Massachusetts College of Art student.

Boston Police report that Shepard allegedly attacked the female student on November 26 in the college’s bathroom. She told police that she was approached from behind and Shepard sexually assaulted her and tried to Rape her. After a struggle, Shepard allegedly fled that area. It’s unclear whether Shepard was also a Massachusetts College of Art student.

Venard Shepard was arraigned yesterday morning in the Roxbury Division of the Boston Municipal Court on Sex Crimes Charges including: Assault with Intent to Rape; Aggravated Assault & Battery with a Dangerous Weapon; and Assault & Battery.

Boston Criminal Lawyer Lefteris K. Travayiakis successfully represented a man falsely accused of raping of a woman dating back in 1988. The client had initially been indicted in 2003 with two counts of Aggravated Rape and Kidnapping. The Suffolk County District Attorney’s Office alleged that the defendant had raped a woman in 1988, but no one had been charged until the defendant’s DNA was linked in 2003 to the complainant’s physical evidence.

Prior to his trial in 2005, the Kidnapping charge was dismissed for being beyond the Statute of Limitations; and the client proceeded to trial on both counts of Aggravated Rape.

The complainant initially reported the alleged rape in 1988. She alleged that, while she was walking down the street, a car pulled up and a man jumped out and ‘snatched’ her into the car, blindfolding her and putting a gun to her head. He then allegedly drove her to an unknown location; got a motel room; allegedly raped her; and then drove her back to the area from where he allegedly kidnapped her.

He was charged with two counts of Rape of a Child by Force; Home Invasion; and Armed Assault to Murder. Following his arraignment in Cambridge District Court last month, he was ordered held on $1 million bail.

As previously reported in the Boston Criminal Lawyers Blog, the Middlesex County District Attorney’s Office alleges that Colono entered the victims’ apartment with a large butcher knife and forced the 11 year old boy to lie on top of his father while he searched the home for things to steal. He then allegedly brought the father and son to a bedroom, where he assaulted the boy at knifepoint. Upon the boy resisting Colono’s demands, he allegedly stabbed the father 8-10 times in the neck, and 3 times in the back, almost severing his head.

David Avery, 31 of Tewksbury, was arraigned yesterday in Salem District Court on two counts of Statutory Rape against a 14 year old girl.

According to the Essex County District Attorney’s Office, the girl mistakenly sent Avery a text message earlier this summer. Avery continued to text with the girl, however, and eventually convinced her to meet with him sometime in August after a back and forth of sexually explicit text messages. The girl alleges that she me with Avery in a wooded area in Salem on August 21, where he sexually assaulted her.

The Sex Crime of Statutory Rape carries a potential punishment of a state prison sentence for any term of years, up to life. Additionally, a conviction for Statutory Rape, as with other Sex Crimes, would render Avery subject to Sex Offender Registration with the Massachusetts Sex Offender Registry and could result in a term of community parole supervision for life.

Daniel Rhoades, 24 and a homeless man from Quincy, and Alexander Zerchykov, 51 of Boston, were both arrested this past weekend in separate cases involving Sex Crimes on the MBTA.

Rhoades was arraigned this morning in the Boston Municipal Court on Sex Crimes charges including Open and Gross Lewdness. He is alleged to have exposed himself to women on the Red Line on two separate days, August 16 and then against on August 17.

Zerchykov was also charged with Indecent Assault & Battery. He is accused of fondling a woman as she was getting off a Green Line train at Boston’s Fenway station on June 13.
